These Terms & Conditions ("Terms") govern your access to and use of the tamakun.sa website and the applications and services provided by Tamakun ("Tamakun", "we", "us", or "our"). By accessing our website or using our services, you agree to these Terms. If you do not agree, do not use our services.
1. Definitions
- Services — the tamakun.sa website and Tamakun's applications, including campaign-data ingestion, the AutoChat customer-service inbox, and social engagement monitoring.
- Client / you — the business or individual that registers for or uses the Services.
- Platforms — third-party services you connect to the Services, including Meta (Facebook and Instagram), TikTok, and WhatsApp.
2. The Services
Tamakun provides software that helps businesses (a) import and analyze marketing and advertising campaign data from their connected stores and ad accounts; (b) manage customer conversations from social media direct messages and WhatsApp in a single inbox (AutoChat); and (c) monitor the comments, likes, and reactions on their posts and advertisements.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information and for maintaining the confidentiality of your credentials and all activity under your account.
4. Connecting third-party platforms
When you connect a Platform, you represent and warrant that you are authorized to connect that account and to grant us access to its data. Your use of each Platform through the Services remains subject to that Platform's own terms and policies, including the Meta Platform Terms, the TikTok Developer / Platform Terms, and the WhatsApp Business Terms. We access and use Platform data only as you authorize and as the Platform permits. You may disconnect any Platform at any time.
5. Acceptable use
You agree not to use the Services to: violate any law or third-party rights; send spam or unlawful, harmful, or misleading content; infringe intellectual property; attempt to gain unauthorized access to systems or data; or interfere with the operation or security of the Services or any Platform. You are responsible for the content you send and the communications you conduct through the Services.
6. Intellectual property
The Services — including all software, design, and content (excluding your data and Platform data) — are owned by Tamakun and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of your data.
7. Privacy
Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms.
8. Third-party services
The Services depend on Platforms and other third-party services that we do not control. We are not responsible for the availability, accuracy, or actions of those third parties, and their terms govern your use of them.
9. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Tamakun will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Services.
11. Indemnification
You agree to indemnify and hold Tamakun harmless from claims arising out of your use of the Services, your content, or your violation of these Terms or any Platform's terms.
12. Suspension and termination
We may suspend or terminate access to the Services for violation of these Terms or to protect the Services, our users, or the Platforms. You may stop using the Services at any time.
13. Governing law
These Terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes are subject to the competent courts of Riyadh, Saudi Arabia.
14. Changes
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
